2. Specialized Equipment & Product Nature

Important Notice: Technical Expertise Required Unlike standard consumer electronics, many products sold on Smarket are professional-grade security and technical equipment.

  • Professional Installation: These products are designed for installation by licensed security technicians or IT professionals. They often require complex configuration (e.g., IP networking) and do not always include consumer-friendly manuals.

  • No Technical Training: Smarket is a retailer, not a technical training institute. We do not provide installation support, remote configuration, or detailed technical walkthroughs. By purchasing, you acknowledge that you possess the necessary skills or will engage a professional.

3. Firmware, Software & Warranty

  • Modification Risks: Updating a device with incorrect firmware, region-incompatible software, or third-party modifications can permanently damage ("brick") the device.

  • Warranty Void: Any device failure resulting from user-initiated firmware flashing or incorrect software updates is not covered under warranty.

  • Recovery Services: If we agree to attempt a recovery service for a "bricked" device, a service fee will apply regardless of the outcome.

4. Fraud Prevention & Order Verification

  • Verification: We utilize automated fraud detection to protect our customers. For high-risk orders, we reserve the right to pause the order and request additional payment verification to ensure the transaction is authorized by the cardholder.

  • Cancellation: Failure to provide verification upon request will result in order cancellation and a full refund.

5. Pricing and Orders

  • Currency: All prices are in Australian Dollars (AUD) and include GST.

  • Order Rights: We reserve the right to refuse service or cancel orders for reasons including stock unavailability or pricing errors.

6. Shipping and Delivery

  • Policy: Shipping rates and estimated delivery times are governed by our separate Shipping Policy.

  • Risk of Loss: We are committed to ensuring your order reaches you safely. Please refer to our separate Shipping Policy for comprehensive details on how we handle and resolve any issues with lost or delayed packages in transit.

  • Accuracy: We are not liable for packages lost due to incorrect addresses provided by you.

7. Returns and Refunds

Our returns are governed by our separate Return and Refund Policy and the Australian Consumer Law (ACL).

  • Restocking Fee: As detailed in our Return Policy, non-faulty "change of mind" returns are subject to a 15% restocking fee and must be unopened.

  • Faulty Goods: We will fulfill our obligations under the ACL for any products with major or minor faults.

8. Limitation of Liability

To the extent permitted by law, POWERCX PTY LTD (trading as Smarket) shall not be liable for indirect, incidental, or consequential damages (including loss of profits or data) arising from the use of our products. Our liability is limited to the amount paid for the product.
